Today is court! Im feeling pretty calm but could use some fingers crossed. My Moms boyfriend made a comment last night that fit really well. It said something like A strong voice doesnt have to be a steady voice. Thank you everyone so much in advance, everyone here has helped me to be a strong person through this.

Thank you ssoooooooo much! Court went pretty well. The judge made him sign a thing saying he wasnt contesting the paternity (didnt know it was an issue), Tony gave his permission to the judge saying I could use the court papers from the other kids, then the judge sent us back to mediation. So I guess the way this works is that we deal with one little issue per hearing. But either way I get the mediator to see my bad parent proof so that is very good! But the fact that thi is going to drag on forever is well kinda _wedgie_ LOL Thank you all sssssoooooooo much for all of your love and support!

I wanted to update everyone on how mediation went yesterday.


He called me yesterday morning saying he wasnt comming.
I was pissed cause I thought they would put off mediation again. Last time they put it off cause he wasnt there.
So I got there and she saw me and asked if I was still pursuing full custody with no visitations and I said yes. She said it is not often we recomend that to the judge. There has to be ample proof that the child could be in danger. I said if you look at my papers, which he gave permission for you to see at court, I think you will see the history he has with his other children will show you my child could also be at risk.
So she finally after all this time got to see my papers on the abuse to his other children. I thought that would be my biggest success of the day.
After she was done typing in her computer everything my papers said she looked at me and said because of his criminal history, his lack of participation in mediation, and your papers I am going to recomend to the judge that you receive full custody with no visitations. I about fell over. I couldnt beleive it.
Now all I have to do is go to court next month and pray he feels like he has lost and doesnt show up and it will be done!!!!

Im soooo releived and gratefull for all the love and support I have received here.

I need to post a request for energy for my daughter. Her trial against the guy who crashed his car into hers three years ago finally starts a week from tomorrow and the stress and worry has been getting worse and worse. Not to mention the pain and disability and the fear that she could end up paralyzed from the neck issues. I don't know if she'd be able to go back to court and get more money if that happened in a year or in 5 years - as a result of the trauma to her neck.

Just saw this... and of course you get warm hugs and Universal Energy for the courts to protect you and your child(ren).

Having said that I am sending extra hugs and energy to help with your stress and worry over this. I would also suggest you ask a good friend to drive you to the final hearing and to be with you while you wait to be called. Even tho they cannot be in the court with you (usually) they will be able to drive, hold your hand and help with coping with the stress. Finally you have my wishes that the Judge actually listens to the recommendation of the mediator. Blessed be.

I just got off the phone with Torias father and he is going to fight the mediation decision. He says that none of what is stated in there is true. Which means the judge will send us back to mediation and we wont be done with this on the 12th. He says he is still going to tell the judge to give things to me my way but he is going to say he wants a dead line on seeing Toria. I told him no, Im not going to cave in on this. If I felt Toria's best interest was too see him I would allow it but he has at least 4 f%&%ed up kids (dont know about the 5th) why would I allow her to be put in that situation? Why would he fight the info in the report and then turn around and say I can have my way with this? I dont think this fight is over yet._inabox_

Believe it or not Im handeling this possible set back well. At first when I talked to him I was off the charts angry. I was so angry I was shaking and in tears. But I smelled my Galangal which reminded me I already have a plan against this and I needed to remember my plan and have faith in the Goddess that she will ultimately keep Victoria safe. Untill I have to see him on the 12th Im screening my calls and not going to answer him, that way Im not loosing my focus. He did make the offer that we could get back together for Torias best interst. :awilly: But he can fight over the wording of the report all he wants, its done and sent in, and in the end I dont really care as long as the judge sees the truth behind him.

LK I think most of his actions are being pushed from behind by the g/f. I seriously doubt he would choose to go head to head with me on this. Either way I will not stop fighting this. I am a Leo and my heels are dug in. When ever I have doubts on taking Toria's father away all I have to do is pull out the court papers from when he pled guilty to attempting to strangle one of the twins. So even though that county has let him have unsupervised visitations with the same children I know in my heart he will not see her untill she is old enough to understand.

A friend suggested that since the lawyer seems to have caused this delay by waiting until the last minute to inform witnesses of the trial date and at least one important witness (a doctor) is out of the country, so that the trial had to be postponed another 3 freaking months, that instead of him getting 40% of the amount awarded (after everything has been paid - past due bills and court costs, etc) he should only get 30%.

I'm not sure that's the right percentage, but I think it's fairly standard when a lawyer takes a case on the basis that he only gets paid if he wins.

Great News!!! The judge asked me how I felt about the mediators report and I told him I agreed with it. He then asked Tony how he felt and he said he would not fight it. So the judge made his order that I have sole custody of Toria with no visitations from the father. I am so releived I cant even tell you. All I have to do now is child support and we will be done (I didnt know I could do it at the same time).

I do feel bad for Tony though. I found out today that the g/f is the one that has been pushing this. He of course wants to make her happy and at the same time he knows it is in Torias best interest to do what I want. Unfortunately she cannot see all the facts, just that right this minute he is playing Daddy with his other kids and I am the one "keeping him from his baby."

It has been so nice though. I simply have no anger for him any more. I have been working hard since I talked to him on the phone last to just let it go and allow the Goddess to take care of us and that is what has happened.

Thank you so much to all my friends that have loved and supported us through this. I really could not have done it with out you.

Thank you all so much. It has been so nice. I have gone from not sleeping and eating anything in sight to a much more stable person. Its just like this huge weight is lifted and I can deal with anything now. I even have money set aside in case the bike for her birthday doesnt come through he promised her. Im just able to think ahead now. It is wonderfull!
