I am looking for a spell to get rid of the mice in my house. Should it be a banishment spell or more of a protection spell? What sign should the moon be in, what herbs/insence/oils should be used?

have you considered useing more Practical means

such as some cheeze and a few mouse traps,

seriously, mabey you can do some sort of ritual to state your intent to add power to them!

Peanut butter works much better than cheese in any mouse trap.

Anise, on the other hand, attracts mice, so a little anise oil or a few anise seeds mixed with peanut butter is far more effective than cheese as bait for a mousetrap. Velerian is also good bait for mice, as well as for rats. "

For color, I would use black for banishing and removing. You could annoint a candle with mint oil to incorporate the mint. I would also do the spell during the waning moon since you are trying to be rid of something (diminishing).

You might also use representations of mousetraps in the spell somehow with the intention of warning the mice. (Sorry if that sounds goofy). For that matter, you could also use representations of cats. OR you could get a cat ;)

Mithrea has great ideas. In short you should use what correspondences seem to you - what moon phase and so on. What makes you think of getting rid of mice? You can do a protection spell or banishing, but please be kind and do a positive banishing - ie. visualizing them finding a new and better home. You might also use catnip to associate with cats as an herb etc., and might choose to appeal to Artemis or another animal loving god to find them better homes.

You can use Havahart traps if you do trap... Just take them about three miles from your home before releasing them in some brush.
