Arsonists yesterday re-lit blazes barely fought into submission by overstretched fire crews. As Victorian Premier (State Governor) John Brumby yesterday broke down in tears over the horrifying events, South Australian Premier Mike Rann described the arsonists as "terrorists". NSW Premier Nathan Rees agreed, saying anyone caught lighting fires in NSW would be severely dealt with. "This is not fun, this is not something clever," he said. "This is something that can kill people."

One suspected arsonist was stopped by a witness who made a citizen's arrest after noticing the man acting suspiciously at Mount Penang Parklands, on the Central Coast. The 31 year old Killarney Vale man, who was seen emerging from a reserve at Somersby which was ignited a short time later, was stopped on Saturday. Yesterday he was charged with a range of offenses and ordered to face Gosford Local Court.

The Victorian Country Fire Authority had already confirmed many of the fires that ripped through the state on the weekend were deliberately lit. "These people are terrorists within our nation, they are the enemy within and we have to be increasingly vigilant about them," Mr Rann said. Police warned any of those caught setting the fires could be charged with murder, as the death toll yesterday grew at a sickening rate.

CFA deputy chief Steve Warrington said firefighters battling a blaze at Churchill were being hampered by at least one firebug, re-igniting areas after fire crews had been through to extinguish the fire. "We know we do have someone who is lighting fires in this community. While we often think it's spotting, we also know there are people lighting fires deliberately," he said.

Victoria Police Deputy Chief Commissioner Kieran Walshe would not say which fires police believed had been the result of arson, but a police spokeswoman said anyone found to have lit the fires would likely be charges with murder or manslaughter. "They can be charged with murder, it depends on the evidence that comes to hand," she said.

Firebugs who set deadly fires in Victoria on the weekend could be charged with murder, the federal attorney-general says.
Robert McClelland has told parliament that Prime Minister Kevin Rudd was right to call arsonists "mass murderers" in the circumstances.


"Anyone who lights fires deliberately, with reckless disregard for the safety of their fellow Australians, in our view establishes the requisite criminal intent that would sustain a charge of murder," Mr McClelland told parliament. To successfully prosecute a murder charge, police must prove that someone committed the physical act that killed another and that they intended for the person to die.


Anyone who withheld information about firebugs' activities in the bushfire disaster could be charged with being an accessory to murder, Mr McClelland said.
"We would point out that the same criminal principles in respect to accomplices applies, and we would strongly recommend anyone who has information about the deliberate lighting of fires to approach the authorities to provide that information."


Earlier on Monday, Mr Rudd said that if the Victorian fires had been deliberately lit it would amount to "mass murder".

A 15-year-old boy has been charged with lighting a scrub fire in the NSW Blue Mountains. The charges relate to a fire in bushland behind a community hall at Faulconbridge in the Blue Mountains on Sunday afternoon.


The small scrub fire was believed to have started after an explosive device was ignited, police said.
The blaze burnt a small area of bush before being extinguished by the Rural Fire Service.


No one was injured and no property was damaged.
A 15-year-old Faulconbridge boy was charged with damage property by fire, cause or set fire to property of another and possess explosive.
He was bailed to appear at Parramatta Children's Court on March 2.

Could get out of hand... I almost feel sorry for the culprit that get's caught by the newly homeless before the police. Almost.

Mongrels. It was all over the news yesterday, and more people than suspected were confirmed dead. Tragic, even more so knowing parts where deliberately lit.

With 131 dead, possibly to rise over 200, they better be charged with somehting worse that murder. Mass murder prehaps. If only there was an easy way to catch them.

*shakes her head* People are just...ugh. There aren't even words sometimes. I certainly hope justice is served, though it will never be enough to cover the lives lost.

173 lives lost this morning, over 900 homes. Whole towns removed from the map.

There isn't a punishment harsh enough for that.

Arson is a terrorist act!

we had a forrest fire here a few years ago in EHT. They caught the kids who did it.. They had to put in in protective custody for a while.. Millions in crops and property were lost.. thankfully no one was hurt by the fire.. but many lost their homes ..

KIDS!! I couldn't believe it..

yeah there is, bound them up with leather collars, strip them naked, paint them with honey and drop them off near a bee keeper's farm..

they will PRAY the heat from the sun shrinks the collars before the bees get to them.. :evilway:

You know, I'm not sure that is enough for almost 200 dead and 900 homes...

And I'm not usually violent or vindictive...
