OK this might not be the best palce to post this, but I need some help from you guys if you don't mind....:rolleyes:
Anyway, for the last few years my hubby and I have been not in the best shape finically, and have been considering the idea of going through bankruptcy... Just wondering if any of you have been trought this? If you have, got any adive????

ohh i understand that!! Trying to get this mortgage which we can't not enough money down!! i thought the same thing!! Though i opted for consumer credit so it looks like i can pay the bills or so i thought so it's the same thing to most agency as filing bankruptcy! So my question to you is depending on how much your in debt for? Call a lawyer and see what you lose by doing it? Or call consumer credit and see if they can help you put everything into place and make one lump sum payment!

I thought about it too, after coming out of a bad relationship where everything was in my name...so I had a car payment, 20,000 in credit card debt...I just consoldated like the dickens and didn't end up needing it...So look around and see what you can do with consolidation...

A competent attorney will advise you whether you need to file bankruptcy (& which chapter; some wipe debt out, some consolidate, some kinda do both), or whether you should do the credit counseling thing. Start there. If you start at the credit counselors, they will pretty much ALWAYS advise you not to do bankruptcy, 'cuz you pay them a fee every month, conveniently included in your monthly payment. And the creditors will usually still call you. You pay the lawyer once, & if the creditors continue to call you, you just call the lawyer. Tried the credit counselors, am in the process of bankruptcy (my ex got custody of the kids, I got custody of the debt).

we did try going through some comsumer credit thingy but that didn't work out well. :( ended up paying them more then what they sent out to get cleared up...

A friend at work just gave me the name of an attorney that she has delt with in the past. I think I'm going to be giving them a call later!

If you file a chapter 7, you'll end up owing nothing, but you'll also end up not having the big stuff like the car that you owe the debt on. Some lawyers will tell you that they can file some paperwork to make it so that you can keep it and still walk away with no debt, but the loan companies don't have to agree if they don't want to. And you'll pay the attorney extra for all those papers he files, and will still not end up with what you want.

On a chapter 13, you can usually make arrangements to keep some of the property, for example you may get to keep the car if they agree to it, maybe with automatic withdrawals from the checking account. And I state MAY, if you've been dodging creditors for a while they don't have to be cooperative. If they think you may skip town or try to hide your assets, you won't get to keep anything.

Your biggest problem with this will be the attorney, will he milk you dry by telling you he can keep filing papers, knowing that you have a 99% chance of losing?

I deal with this exact situation 40 hours a week, and it's never fun or easy, but you can get through it with grace and dignity. Best wishes.

Well we own our car is a POS but it runs, we rent our place, so we don't have that to worry about. What got us into trouble was the fact that when we first got married we had to live off a credit card, there was hardly any work to be found where we were. And a few years back I had alot of meidical problems and I didn't have insureance.

it was an '87 ford crown vic "police special" with a "high output" engine and heavy duty everything, i've got two of them parked in my yard and they're a hell of a car. we won't discuss what i was doing one night out on I-91 late one night after all the state troopers had gone to bed but you can believe it when you look at the speedometer numbers reading up to 140 mph.
